Privacy Policy and Cookies

 

1. The protection of personal data of the Buyer, who is a natural person, is governed by Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) – [hereinafter referred to as “GDPR”], as well as other relevant legal regulations.

2. The Buyer acknowledges that the Seller, as the data controller, will process their personal data based on the legal grounds specified in Article 6(1)(b), (c), and (f) of the GDPR for the following purposes:

a) to fulfill the Contract;

b) to comply with legal obligations (especially accounting and tax-related obligations);

c) to pursue the Seller’s legitimate interests, which include assessing the validity of claims raised by the Buyer, defending against unjustified claims, improving and protecting Goods, tracking customers based on the type of Goods, analyzing the relevant market (including statistical analyses), and organizing loyalty programs.

The Buyer acknowledges that the Seller, as the data controller, will process their personal data based on the legal ground specified in Article 6(1)(a) of the GDPR – the Buyer’s consent – for the following purposes:

a) to create and enable the use of a User Account;

b) to send commercial communications (newsletters under Act No. 480/2004 Coll., on certain information society services, containing information about new products and services offered by the Seller);

c) to offer individual promotions and provide personalized bonuses (rewards);

d) for PR, marketing, and promotion of the LAYER ZERO brand.

3. Consent to the processing of personal data as described in the preceding paragraph may be withdrawn at any time, for example, by sending an email to gdpr@layerlabs.store. However, such withdrawal will not affect the lawfulness of personal data processing based on the consent given before its withdrawal.

4. The Buyer acknowledges that if they submit a review of a LAYER ZERO product, they consent to its publication on the website layerlabs.store, social media, advertisements, and other marketing materials associated with the LAYER ZERO brand. The review will include the name or nickname under which it was submitted and the text of the review itself. If the Buyer wishes for the review to no longer be published or used for marketing purposes, they can communicate this decision via email at gdpr@layerlabs.store. The Buyer acknowledges that once a marketing material is published, and in some cases after its creation, it may not be possible to remove their personal data (review and author details) from the material.

5. The Buyer acknowledges their obligation to inform the Seller of any changes to their personal data to enable the Seller to fulfill its obligation to process accurate data.

6. The Seller may delegate the processing of the Buyer’s personal data to a third party; possible recipients include goods carriers and processors such as tax, accounting, and legal advisors, hosting providers for the E-shop, and providers of services related to the operation of the E-shop’s web interface.

7. Personal data will be processed for the period necessary to fulfill the purpose of the processing. Personal data processed for purposes under paragraph 2 will be processed for at least 10 years (the exact duration depends on current legal regulations, such as those requiring the archiving of issued invoices for a specified period) from the date the Goods are delivered to the Buyer. Personal data processed based on consent will be processed until the consent is withdrawn by the Buyer. Data will be processed electronically using automated means or manually in paper form.

8. A Data Protection Officer has not been appointed.

9. The Seller will not transfer personal data to third countries or international organizations. However, some cookies (see below) may be transferred to servers in the USA. Such transfers will only occur if the respective processor agrees to comply with the standard contractual clauses issued by the European Commission and available at http://eur-lex.europa.eu/LexUriServ/LexUriServ.do?uri=OJ:L:2004:385:0074:0084:CS:PDF. Google Inc., located at 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA, processes cookies in accordance with its privacy policies available here. Facebook Inc., located at 1601 Willow Road, Menlo Park, CA 94025, USA, processes cookies in accordance with its privacy policies available here. Facebook Pixel cookies are processed by Meta Platforms, Inc. in compliance with GDPR (more details here).

10. The Buyer has the right to request access to their personal data from the Seller, as well as the right to rectification or erasure, the right to data portability, and the right to object to the processing of their personal data.

11. The Buyer has the right to lodge a complaint with a supervisory authority, which in the Czech Republic is the Office for Personal Data Protection (www.uoou.cz).

12. Providing data for the purposes specified in paragraph 2 of these Terms is a legal requirement; therefore, the Buyer is obliged to provide such data; otherwise, the Seller cannot conclude the Contract or fulfill its obligations under it. Providing personal data based on the Buyer’s consent is voluntary, meaning the Buyer is not obligated to provide such data if they do not wish to utilize those options.

13. No automated decision-making, including profiling, will take place.

14. Upon the Buyer’s request for information about the processing of their personal data, the Seller is obligated to provide such information.

15. The Buyer has the right to object to the processing of their personal data if such data is processed based on Article 6(1)(e) or (f) of the GDPR and if their data is processed for direct marketing purposes.

16. In addition to the rights mentioned above, under GDPR, the Buyer also has the following rights:

 

the right to restrict processing;

the right not to be subject to a decision based solely on automated processing, including profiling.

 

17. The E-shop uses cookies. If the Buyer disables cookies in their browser, some features of the E-shop may not function properly, which could negatively impact their shopping and browsing experience.

18. The E-shop primarily uses cookies to:

 

assist in remembering and processing items in the shopping cart;

compile aggregate data on E-shop traffic to improve its operation in the future.

 

19. The E-shop uses Google Analytics to automatically collect and store certain data, including IP addresses, browser types, operating systems, timestamps, and clickstream data. These data, which do not identify specific individuals, are used by the Seller to analyze trends, optimize the E-shop, monitor on-site movements, and gather demographic information about the overall E-shop user base.

20. The Seller respects “Do Not Track Signals” settings. The E-shop enables third-party tracking.
